What is the name of your state? FL
I have health insurance with my employer and have heard that in FL your common law S.O. is entitled like a spouse to your health insurance too-- by law.........is that so? BTW--we have bought a house together etc....

My response:

You cannot be "common law" married in Florida.

But, Florida will "recognize" a common law marriage IF you were common law married in a State that DOES HAVE common law marriage on the "books".

Are you both from another State?

Sorry, then you're out of luck. You're about 35 years too late - -

After January 1, 1968, common law marriages entered into the State of Florida are void. Florida Statutes Annotated, provide in pertinent part:

741.211 Common law marriages void
No common law marriage entered into after January 1, 1968, shall be valid except that nothing contained in this section shall affect any marriage which, though otherwise defective, was entered into by the party asserting such marriage in good faith and in substantial compliance with this chapter. Laws 1967, c.67-571, § 1 eff. Aug. 3, 1967.


So, the only way to get around this situation is to do what you don't want to do - - - get married.
