my late husband owned a home only in his name. as his wife and personal representative, i filed a claim against his homeowner's insurance company for items stolen out of the house by his son (a collections of guns, world war 2 memorabelia, and other collectible items worth about $40,000). the case is currently in litigation, but the insurance company is telling me that because none of the items in the house belonged to me that i have no right to file a claim. i thought as his personal representative that i have a legal obligation to "gather and account for all assets" belonging to his estate. is the insurance company trying to pull the wool over my eyes or should i pursue the claim? Thanks.
