husband passed away please help


What is the name of your state (only U.S. law)? florida
my fiancee was married and her husband passed away and his employer refused to give her any info on his benefits life insurance policy that was paid for by the company. we have now discovered that there was a policy in effect but the death occurred over four years ago. is there some sort of statute of limitations for making a claim and is there any recourse against the company for witholding the info when she clearly asked over and over and the human resourses girl claimed that there was no policy in place.

So why didn't she get an attorney's help four years ago to get everything figured out or did she just let it go because of grief or not knowing what do? Does she know the name of the insurance company and the name of the person who was paid the proceeds of the policy? Could a possible reason that the husband's employer did not want to reveal any information is that perhaps the beneficiary could have been a girlfriend that the wife did not know about? What was the policy worth?

If the husband had an estate that was probated in the county courthouse probate court, look at the probate file to see who the executor was, and then ask the executor to get the information you want from the insurance company. The executor is the only person legally authorized to request information.

If there was no estate and no executor, she or her attorney can file paperwork to open up an estate, and will soon be issued a document called letters testamentary which will give the executor/personal representative authority to get the information about this policy.
