Insurance don't pay despite letter of subrogation.

Our 4 yr. old daughter slipped and fell in a ceramic bathtub with no anti-skid in a hotel in FL. She had a seizure, then became unconscious and was taken to the ER for a catscan, which showed nothing ($1600.00).

Back in ND she was behaving strangely and the hotel would only pay the ER bill if we would sign a release. We then hired an attorney and had her evaluated by a neuropsychologist ($2500.00)who recommended therapy once a week for 3-6 months ($200.00/week).

Our own Plan denied coverage for the ER bill because it was due to an accident. We then signed a letter of subrogation with them but they still didn't pay. Then they said they needed the name and address of the primary insurance (the hotel's) which was provided to them. They still didn't pay.

The accident happened in Sept. and today I got a call from the hospital in FL saying they would send the bill to collection. This wouldn't have happened if our Plan had paid the bills.

Will our Plan be at fault if our excellent credit rating is ruined because of this? Can we take any actions against them?

We are waiting for the report from the neuropsychologist before we can settle with the hotel and in the meantime I see our credit rating going down the tube.

You've already hired an attorney. ASK THAT ATTORNEY as s/he knows the facts and is in the best poosition to help and can send a letter on your behalf if appropriate.
