Question re: Tobacco User


What is the name of your state (only U.S. law)? Indiana

If someone has been paying non-tobacco user rates for a term life insurance policy and is a tobacco user when they die, is the insurance policy invalid?What is the name of your state (only U.S. law)?

Basically, yes. If you are paying for non-user rates, but a tobacco user, then you are violating the contract of the insurance and the company and probably will deny any payments.

Perhaps no. Generally the policy is based on what is going on at the time it is applied for. You can apply as a nonsmoker if you are a nonsmoker and then later on after the policy is issued light up. There's also frequently a two year contestability period. If they don't notice the noncompliance they waive their rights to gripe later on.

You'll need to read the policy to know for sure.
