16 yr old being abused, need advice


State is Colorado. My son's 16 yr old girlfriend and 10 yr old little brother are being abused, both physically and emotionally by their custodial father. Their mother has a history of drug use (but was never in trouble with the law so has no record or documentation) and a husband that may have molested or tried to molest the girl. Both know of the abuse but have done nothing and live out of state. There is family that will take in the boy if need be but not the 16 yr old. She is afraid to report the abuse, afraid CPS will send her to her mother, afraid CPS will do nothing and abuse will get worse. Does she have any rights? If she decides to leave, will she be considered a runaway? If she doesn't live with either of her parents, are they required to provide for her support? She has a friend that she may be able to stay with, but no other means of supporting herself while in high school. Can she be forced into a foster home or forced to relocate to her mother and stepfather and another abusive situation? Any help would be appreciated. I am afraid to report this myself until I am sure that I won't make it worse for her. Thank you.

You did not elaborate on the abuse, nor did you state that you have firsthand knowledge of the abuse. If you are reasonably certain that physical abuse or sexual abuse is present in the home, I hope that you pick up the phone and call the DSS child abuse hotline, and the police.
DSS can place the children in a safe haven if they find abuse to be present. The judge, or DSS without using a judge, can place the children with family or friends who are capable of providing a safe haven for the children.
If you know that the children are in danger, please do not hesitate to call either DSS or the police, or both. If you believe the children are not in immediate danger of harm, but are being abused, please call DSS and report the circumstances. They will investigate and take actions necessary to protect the children.
Sometimes turning away from seeing abuse results in the death of the child. Please don't let that happen.
