i would like to know how to prove adultery in the state of idaho. my rat of a husband moved out in january and slept with another woman while still legally married to me. my lawyer found a legal loophole which allows me to get out of the state where i currently reside with my son and the state i'm moving to would allow me to pursue adultery as grounds for our divorce should i be the one who files. i know that the burden of proof would fall to me and i need to know what i would have to do to prove adultery.

I'm not an Attorney, but someone who has unfortunately been in your position. Ideally, to prove adultery, hire a pi - and get photos, with dates showing, of your spouse & their non-marital partner. Additionally, try to get copies of past phone bills (home, cell phone, car phone) which could show your spouse conversing with this person. Also, if you have a computer, you can get history/copies of all the email correspondance that could have taken place between him & her. Lastly, talk to your friends, were any of them aware of your spouses relations with this person? Would they be able to testify & provide specific dates & locations of when they witnessed this action? I'm sorry that you have to go through this - no one should have to. Good luck.
