Am I legally married? Help!!


I was married in Las Vegas Nevada, I live in Oregon. I found out my husband had never divorced his first wife (he is lazy, not a scheister) I do know that my marriage would be null and void if we were married in Oregon BUT, we were married in Las Vegas and I can't seem to find anyone who can answer definitively if my marriage is null and void according to Nevada laws.
I ask because filing for divorce is spendy and I'm a single mother, I would like to save the money for a more worthwhile cause, like food for my kids. But I am adamant about being legal. What if I would like to marry my boyfriend someday? Would I be committing bigamy?

YOU Would be committing bigamy until such time as you have the Vegas marriage voided.

Would annulment be an option?

Anullment is the option since the marriage was based on fraud.

if you dont have children or own any property together you or he can get the paperwork and file the divorce. its very ez and inexpensive. you can get the proper forms from your local courthouse and maybe even on-line.

Am I legally married?


I already have the divorce papers. I ordered them online, spent the $85 to have them prepared and do not want to cough up the $400 filing fee if I don't have to. I'm a single mother of three that really doesn't have the cash to spare.
Like I said, I was told that if we had been married in Oregon, there would be no problem, our marriage would be null and void. I just need someone familiar with Nevada law (I have found all the statutes online regarding this but even my lawyer says the way it is worded sounds bizarre) We have no property together, no kids, no bills, we have been split up for 3 years, I just want to know, according to Nevada law, is my marriage void?

**A: your marriage is null and void regardless. It does not matter what state you got married in since you marriage would not be legal in any of the 50 states because he was already married.

NRS 125.290 Void marriages. All marriages which are prohibited by law because of:

1. Consanguinity between the parties; or

2. Either of the parties having a former husband or wife then living, if solemnized within this State,

Ê are void without any decree of divorce or annulment or other legal proceedings. A marriage void under this section shall not bar prosecution for the crime of bigamy pursuant to NRS 201.160.
