Assets acquired during legal separation

Is property (real estate) acquired by one spouse during a legal separation considered community property during allocation of assets when the divorce agreement is drawn up? My friend and I would like to buy a house together, but he wants to be sure that his wife would not be able to lay claim to any portion of this investment, since technically it would be purchased while they are still legally married.

just to be sure, why don't you have your boyfriend get his divorce finalized before buying a house with him? have him just get the marital status dissolved.
