What is the name of your state (only U.S. law)? WI 16-year old son was living with mother. Got into trouble and was facing four felonies (theft >$2500) in two different counties. She kicked him out and he's living with us again. We have primary placement, and we hired attorney. She wanted public defender. We were told by an attorney that there is a law that if we had primary placement, she would have to split fees if we did what was in the best interest of the minor child. I think its iffy that your husband could convince a judge to order her to pay 1/2 of the child's legal fees, when a public defender would have been available. That was a choice your husband made, against her wishes/ability to pay.
