Benefits to Legal Marriage with Child


What is the name of your state? California

My question is what is the benefits to being legally married instead of:

-Living together with a child (both persons are the birth parents)
-Having a living trust which includes the house, all accounts, etc.
-Having each other listed as beneficiaries for life insurance and anything else which involves a pay-out in the event of a death
-Each other has Power of Attorney for the other person
-House deed is only in 1 persons name but payments have been made from an account with both names on it (does that matter in the event of dissolution of relationship?)

Sounds like you have everything covered.

However, please realize that the great majority of these relationships go sour and when they do, they get really nasty.

That's also true of being married, of course.

Silverplum - I am sorry, I'm new here and tried searching for my answers and reading FAQs for an hour before posting with no luck.

SeniorJudge - Thanks for your reply.

I guess my main concern is if I/we will be unprotected in some way, in which marriage would have protected me, if the other person dies or our relationship ends.

A married father has more automatic rights to their child than they do as an unmarried father.

An unmarried partner, regardless of debt obligation has NO automatic rights to any percentage of the partner's separately titled property.

most of the things that you listed can be changed at any given time by one person without the agreement of the other

Social Security Benefits/ Survivors benefits

No divorce party

Social Security retirement or disability benefitts is a big difference. Married shares nbenefits, unmarried does not.
