What is the name of your state? In.
My 12 yr. old son has not seen his father in almost 8 yrs. He made no attempt to see him. In Nov.03, I began to recieve support because the pros.attorney found out he was working. The last time he(father) contacted me was in nov. 97. Now he is raising the issue of visitation rights? My husband (of 6yrs) wants to adopt my son. Ater all this time, will the father be able to stop us from my husband adopting him ?

First off, is there a visitation order in place?

Secondly, it is likely that your ex could stop the adoption. The reason is that CS is considered contact and if he can prove he's ready to be a father now(yes, i realize it's not right) it's likely a judge wouldn't grant the adoption. You should of actually tried for the adoption years ago. It might be too late now.

There is no visitation order. Is CS considered contact even when the only reason Im getting it is because they finally caught up to him?

Yes it is still considered contact.
