Can hospital legally change the last name with out us knowing?


What is the name of your state? Iowa

15 years ago we had a new son. In The hospital we filled out the forms to name him. We was not married at the time of his birth. We put his last name as the fathers last name on the form.
About a week later we get the hospital birth certificate in the mail. They had typed out his full name that we gave him on the forms we filled out. But the last name that we had gave him was whited out and the mothers last name at that time was typed after the whited out name.
Can a hospital legally do this with out us knowing? His birth certificate to this day has his mothers last name.
Each year when we file taxes we have to put his mothers last name on the forms or they will send it back.
About five years ago we went to social security and put in a name change for him. We was expecting the IRS to see this change. They have not! Now I have people tell me that we have to go to the court system to get his name changed to the last name that his has been using all his life.
So my main question is, Can the hospital legally do this? Can we make them this pay for the name change? Plus maybe something for the hell we have been dealing with all this time?

Uh, you clearly knew. Obviously your action violated some current-at-that-time Iowa law. (And I'm not gonna go searching for it.)

I did not ask a question of how dumb I am or was at the time this happen. I did not need to be insulted like that. We all do things that could have or should have been done differently.
The paper work that we filled out should not have been changed! I as the father is not listed on the birth certificate due to the hospitals beliefs.
We never really had a need to have the state certificate until now. He wants to get a drivers permit and get a summer job. But now his ss card does not match up with what is on his birth certificate.
About 11 years ago we was told that all we had to do was change his name with SS. This was due to the way the hospital submitted the info for him. We also was told that the state would have the right info on him that the hospital had to submit the form that we filled out when naming him. So no we did not know all the facts at that time. We was informed of the wrong info.
But Can they do that just because we was not married at the time?

We also have a daughter and at the time when she was born we was not married and had her at the same hospital. Only one year after him but we did not have any problems with naming her and they did not change any info that we gave them.

Chris - you're not getting it. The time to have dealt with this is about 14 years past. Now, you will need to get a legal name change through the courts. You have no recourse with/against the hospital because you waited so long, so whether it was legal or not is a moot question.

and for god's sake, bust out a grammar book and learn the difference between was and were, for your child's sake as well as your own.

Let me get this right, you are a senior member and you are here to help people with problems that they post! Am I right on this????? So why would you be talking trash to people like this?? I told my problem and ask a question about it. I did not know I was going to be insulted like this. I know that you must deal with allot of dumb questions on this forum! But if you can not understand the pressure that some people are under when posting for help, than you have no business in here offering help what so ever.

Don't bother saying anything else to this post. I have got my answers some place else! From people that care and want to help out unlike this place. As far as I am concerned the members of this forum is a joke.

Why don't a few of you get a life and try and understand people a little more before you start stomping them into the ground. We all have problems and reach out for help some time. Why be so rude to people?? There is nothing wrong with asking for help if you come across something that you don't understand. That is how we are grow to understand lifes problems.

Thank you for the ones that care and helped out the best that you could.

have you noticed the name of the site? It is "Free Advice". You got free advice. Just because it was for grammatical incorrectness shouldn;t bee seen as a problem. It was still free.


The one other thing you may look into (I haven;t at all) is a correction to the birth certificate. Some states allow corrections and some apparently don;t have much of a time restriction in seeking a correction.
