Can I or Can't I


VIRGINIA - My brother is going through a nasty custody battle with his ex-girlfriend over their 23-month old son. I have to go with him and video every exchange of the child. The mother of the child is living with her brother in Poquoson on Parcel C. Now they don't want us to video the exchanges. They told me that we (my 3 teenage children, husband and myself) are not welcomed on their property any more. She said that if we come back we will be charged with Treaspassing. I have a copy of the deed and a plot of the land. They live off of a major road on a hard surface road. The deed says "Together with an easement, in common with the owners of Parcels A & B, approximately 15 feet in width for ingress, egress and the provision of utilities, as shown on the referenced plat. Subject, however, to any and all restrictions, easements and rights-of-way of record against said property." And "Easement to Parcels B and C for ingress, egress, and utilities." My brother's attorney, without seeing the papers, says that I shouldn't be arrested for treaspasing. I want a definite answer. Can you help? If not, who can I ask?

My response:

Buy a long lense. Videotape from 1/2 mile away.

Then, when they think you're not there videotaping them, that will be the day when you'll get your best shots!
