I filed bankruptcy in South Carolina. At the time, both myself and one of my roommates needed to file and we were told by the attorney that we needed to file together because it would save us a lot of money. We did file with this attorney for a chapter 11. The following year the same attorney told us we had to file our State and Federal Income taxes together since we had file the bankruptcy together. We filed together for two or three years and I have not filed since then. I am now starting to get concerned about being in trouble with the law. I now want to file my past due two years of taxes and don't know what to do. Do I have to file as a married person? I never married this roommate. I guess my question is complicated but I need to know am I married or not? Do I need to get divorced from the roommate or what? PLEASE ADVISE soon or I will be in deeper trouble for not filing. Thanks, JMHarman |
Wow, with a title like that for your post, I'm sure it'll get alot of views, even if it doesn't get many responses.
Did the two of you file taxes or the bankruptcy as married? If so, then yes, you will probably be in trouble. I'm sorry, I don't know very much about tax or bankruptcy law, but I do know that if two UNMARRIED people file any type of LEGAL documents together which GIVE THE IMPRESSION OF MARRIAGE, it would be fraud.
My sincere advice is that you see a REPUTABLE attorney about it ASAP.
