Changing family name

What is the name of your state? Florida

I'm looking for information about changing the name of our family. My wife and I have been together for 5 years, with two children from her previous marriage. For reasons that aren't really material, when we were married we kept our names at the time which we still have now.

The plan was always to have it changed later, and that's where we are now. What we'd like to do is have our last names changed to something totally different from either of our current names (meaning, my name is A, her name is B, and we want to change both our names to C).

We are going to give the kids the option of also changing their names, but in the interest of keeping things smooth with her ex (who really isn't a bad guy, and I don't see him kicking up a fuss at all), their names will have to be double barreled, which isn't exactly the same as our name, so I don't know if that changes the process.

So, in summary, we are currently:

Guy A
Gal B
Kid1 B
Kid2 B

...and we want to become:

Guy C
Gal C
Kid1 B C
Kid2 B C

And just to throw it out there since it might make the paperwork a little different, my wife has a judgment against her from a subrogation company that successfully sued her for damages related to a house fire that her home insurance had previously covered.

Thanks! What is the name of your state?

I am only addressing the portion about changing the children's names.

Without their father's full consent, your wife will not be able to change their names.

And YOU can do nothing about their names. You are a legal stranger to the children.

You and your wife can change your names to whatever you want...But I doubt that the children will be a part of it. It would not be in their best interest. Social Security numbers will remain the same and I believe that you would have to alert all creditors to the change as well...

As the others have said, your wife will need to get her ex's permission to change the childrens' names. You can find the forms and other info at www.flcourts.org
