Changing My Child's Last Name


What is the name of your state? Georgia

I had my son 8 years ago in California. I never married his father. We broke up 2 years after the baby was born. We never got a court order to establish anything. My son and I moved to Georgia 4 years ago (I did tell the father before we left). He didn't try to stop us. Now I'm married to a man that has known my son since he was 2 years old. I want to know if I can legally change my son's name to my new last name, which is my husband's last name? Currently, my son has my birth name and always has since he was born, which is the same name on his birth certificate. His biological father only wanted his first and middle name on our son's birth certificate so that's all I put on it and that's the way he signed it. My son has a great relationship with both fathers and both fathers support him financially and emotionally. So again, can I change my son's last name and if so, how? My son prefers to have the same last name as me, at least that's what he's told me.

You'll need his father's consent or a court order to change the kid's name.

child's name change


Hi and thanks for the information. So even if my son's father's last name isn't on the birth certificate, I still need his permission to change my son's last name? Okay, I'll get started on that process. I think it's going to open a big can of worms because then my son's father will have to explain to the court why his first and middle names are the only two names on the birth certificate and not the last name he has used for 48 years...
