What is the name of your state? georgia. in jan. 2003 by child was born out of wedlock. he has his father's last name and the biological father is named on the birth certificate. how can i make him legite now. will marriage make him legitimate. he is legitimate since he has his father's last name?

Just putting someone's name on a birth certificate doesn't cut it. The father will have to sign the birth certificate, sign an acknowledgement of paternity or take a DNA test.

i know who the father is, and the father did sign the birth certificate. the father and i have been together for almost 3 years and live together now, but are not married. he doesn't need to anything of that.

The above quote from your first post says that the father is named on the birth certificate. That is different than the father signing the birth certificate; they are two separate things.

So, did the father sign the birth certificate, or did you just put his name on the birth certificate as the father? If he signed, he is the legal father.
