Child name change

What is the name of your state? Illinois

I have a 5 year old daughter from a relationship that ended when she was 2 years old. Her father does not support her financially or visit her more than 2 to 3 times a year. We live in the same state about 15 minutes from each other. Everytime I file for Child support they lose my paper work or say they requested a court date but I never recieved the paper work so they would close the case. On top of that I am currently engaged and my fiance is a significant part of her life so when I do get married I want to change her last name from her biological fathers name to my fiances name. Do you think I should? Her biological father does not want to sign over his parental rights for my fiance to adopt

If the father doesn't want to sign over parental rights and he cares about her and sees her then why would you want to do that to your child? Take her father's name away from her? It's not about money. Paying or not paying child support doesn't mean anything in regards to the rest of it.

You can not change the child's last name without first getting approvable from a court.
