child rights


I live in Arizona and my 13 year old son has decided to live with his dad (who also lives in Arizona) because he has gotten into so much trouble at home. My ex and I share joint custody with primary physical custody to me.

My ex says our son has the right to decide who he wants to live with when he became the age of 13. I thought it was 14. Does anyone know what ht elegal age is for the child to make that determination? Thanks for any help.

Actually it is 18. Before that, a child only has a 'say' in what he wants. They are able to speak with a judge to give their opinion and why they want to move or stay. A child that wants to move to the NCP because they hate doing homework or being in bed by 9pm on a school night will get nowhere when all the factors are taken into consideration.
