Child Support


What is the name of your state? New Mexico

in 1999 i went to court in carlsbad new mexico, child support was ordered.

at this time i began my own attempts to gain custody of my children.

i made the support payments for a time and then discovered that my ex wife was using the money for drugs. she eventually went to prison some years later.

in january 2001, a court hearing was held in carlsbad, i was unable to make the hearing and filed a motion for continuation. this motion was never heard and the hearing proceeded.

needless to say i went into debt over $13,000.00 in one day. according to new mexico law, i had 30 days to pay this amount or at least half of it or my drivers license would be suspended, a negative credit report would be made and so on.

my license was suspended, a negative credit report was made and i have been forced to take odd jobs just help out at home. my current family now recieves assistance from the state because my earning ability has dimished greatly.

new mexico provides relief for people with dui's, dwi's, and other traffic citations to be granted conditional driver's licenses for specific purposes such as work related issues and so on. however the department of motor vehicles does not provide relief for someone who has had their license suspended (for ten years) over back child support. i am told by both the dmv and attorney's i have contacted that since my case is a civil case and not criminal i cannot petition the court to grant such a license to me.

i feel this is discriminatory and the sanctions that have been imposed upon me were meant as a punishment and not an incentive to pay the back child support.

to date i am now over $24,000.00 in debt and still accepting odd jobs in order to help my current family.

can i petition the court to modify the child support and be granted such a provisional license?

one more thing, the case has jurisdiction in carlsbad nm, but neither the mother nor i have lived there in years. can i get the case transferred to where i live? i still live in nm, but my ex lives in another state. also, i informed the state that she was incarcerated for over a year and by their own regulations, child support should have been stopped for that period, it didn't.

need help desperately

This is why it is never a good idea to miss a court date. They got a judgement against you by default.

You're going to need an attorney to help you sort out this mess.

attorney, what attorney


I am in a simular mess, (I would not have care if I live in chicago cause I never used a car their, but in this rural area, its life or death or break the law). I can,t get an attorney to go the other county and sort some of it out. Even the ones that get 250 an hour. Getting an attorney is not a given as everyone thinks.
you are quilty till you prove otherwise is my experience and money get you of regarless.

If lawyers are not the greatest, why is it after my issue is heard, everyone finishes with reccomending, that I should get a lawyer for help.

**I very much doubt that child support stops because one parent is incarcerated, unless YOU had custody at the time, which you never state, therefore I doubt.

You sound like a low-life, whining, sniveling deadbeat who works under the table to support a new family, leaving his children to either languish in foster care, or at the mercy of a mother who is an ex-con drug addict.

But just got aknowlegded as the guy who bumped it. Its nice to see that to by the way. I pay but the licence issue is so different from location to location.
