child support


What is the name of your state? louisiana i was sentenced to 90 days in jail for owed back child support,i was wondering if i still owe her the back child support,ino i owe for the time that i spent in jail .because she keeps treatning to take me to court and she knows i can't afford to go to court i can't even take her to court to drop the child support because i don't make half the money i used to.while i was in jail the warden and the counseler said that i don't owe her because thats why i was in jail i don't no if shes just doing this because she knows i can't afford to go to court so she keeps saying that so i will pay her,so please can anyone help.

What did the judge tell you about the arrears? You still owe, jail is not an exchange for child support...it is a punishment for not paying.

As far as you having to pay while in jail, you should have gotten a court appointed attorney and requested support be stopped for those 3 months. But you did not so you owe.

You CAN go to court to lower support, it takes very little money...filing fee's and some time off work. If you quit a job in order to gain one with less pay then a judge will not feel sorry for you. But if there is a good reason you are at a lower paying job than when support was calculated, it may be lowered.

The only thing the judge said was that i was sentenced to 90 days for not paying back child support.But come to find out when i went to court in may the amount for th support was 2139.00 but that was because my work was steeling the money that was being taking out of my checks for child support,so he gave me 90 days to find out where the money was going.So about a month after my ex called me and told me she got the checks in,so there should have been 4checks each at 500.00 350.00 for regular and 150.00 for back.But when we went to court in august the amount was still the same ,i asked why she lied and she said she forgot.So now from me being in jail i lost my vehicle so i had to get whatever job i can get so thats why i have a lower paying job now because i have to walk to work.

Unless you have something signed by the judge saying you don't owe the back support, you owe the back support. You might be wise to consider a second job so that you can get caught up.
