When the time has expired on submitting an appeal, what other options are available?
A court decision was made in 2002 which deviated by over 100% from the standards and actually put me below the poverty level. In 2003 the judge purged a loan from a court ordered refinancing of my home. I could not afford the amount and although I paid what I could afford, the judge sentenced me to six months for contempt of court.
I have taken care of my daughter 3 days per week so I am not a dead beat dad.
The time expired for me to submit a direct appeal. In 2003 I submitted a habeas-corpus which is now on the federal level. However, I have also sought a 809.51 Rule (Supervisory writ and original jurisdiction to issue prerogative writ) which was denied because they said that the time expired on the significant issues and recently submitted a 809.50 Rule (Appeal from judgment or order not appeal able as of right)the appeals court denied it by indicating that I never filed an Appeal. It was my understanding that once the time has expired on filing an appeal, doing so is fruitless.
The Federal Judge has not decided upon the case because I am being given an opportunity to exhaust my remedies. What should I do next?
