child support utah


my niece got married with her mothers signature , she was 17
the father now says that since she is married he no longer has to pay child support and can go to court to have it ended. can he ?????? they got divorced in utah

My response:

Where did she live, both prior to, and during, her marriage? If she lived in Utah prior to, and during her marriage, he is correct. The State of Utah does not have an emancipation law. However, if a person under eighteen marries or joins the U.S. Armed Forces, parents are not held accountable for their child's welfare.

The only way that child support would start again is if she received an "annulment" of her marriage from the court - - not a "divorce."

Gee, do y'all suppose that's because married folks are supposed to be all grown up and able to support themselves???

Mama should never have signed those papers.
