Children's last name

My husbands ex-wife is putting her married name after his daughter's current last which is his. Is there any legal action that can be taken when she has done this with a bank and a school?

If there was no legal name change then the mom is commiting fraud. You cant give a childs school the wrong name.
she would have to go to court with your husband to have the childs last name changed. And if she went to court without notifying your husband than that is illegal too. Take her to court.
