common law?


I have been with my b/friend for almosy 11 years. We lived together from 92-97 i moved out for 1 year in 98 and currently we live in a 2 family from99-03. i live on 1 floor with my children. ( 1 is his), and he lives with his kids below me. when i met him i had my own house, a new car, and credit cards. now i have no credit, (filed for bankrupcty in 97) was paying him 900 a month in rent never got support for our child untill i started taking it out of my rent. my car is gone, the engine went. he has been saying he is going to get me a car since 4 years now, and he claimes he is broke. we have broken uo, and i am trying to find a apartment, but i think i deserve some money out of this deal. he bought the house we live in now with the money he sued my insurance company when i got into an accident with him in the car. Do i have any rights here? it doesn't seem fair that i have to walk away empty handed. We have never had any support agreements wrote up, and he hides all the money he makes from the irs. please, help!!! any advice????????

Since CT is not a "Common Law" state you have none of the "financial protections" that you would have if if you had married him. However, he does have to pay CS - you may have a hard time figuring out how much CS he would have to pay (actually you both have to pay - from what you stated about your child with him living with you I'm assuming you don't owe HIM) when he hides income. Nevertheless, many states attribute either his "earning capacity" or what he would get as "Unemployment Compensation" when they figure NCP CS. So get those orders in place. Most states have forms called "Petition for CS" available either on their "Family Court websites" or at the Courthouse. Most of the time you will not need a lawyer to prepare the form.

Concerning your 5-6 old bankruptcy: this should be a barrier to obtaining new credit. The effects of bk lesson over time and assuming you haven't made any credit mistakes since you filed, you should be able to buy a new or used vehicle at a decent interest rate.

The time has come to pick your own self up and stop relying on him. I'm not trying to be judgmental here, nor am I pretending I know the whole story. It's just that your living situation seemed strange.
