What is the name of your state? Rhode Island

What are, if any, the laws regarding common law couples and health insurance benefits?
We have been living together just over a year, have a joint checking and savings account, both names are on the lease and we plan to get engaged by the end of the year.
He lost his private health insurance benefits due to a work related injury and is presently out on workers comp. They have let him go from his position and was given COBRA as an option to continue his insurance, however, this was not a financial option.
I work full time and do get health insurance benefits from my employer. I am employed in Rhode Island, however, the main office is located in Connenticut.

Your situation does not confirm to the requirments for a common law marriage in Rhode Island. Otherwise, you would fall under the following:


Section 36-12-1(3) of the General Laws in Chapter 36-12 entitled "Insurance Benefits". This legislation allows state of Rhode Island employees who are already eligible for health insurance benefits to add their domestic partner to their health insurance plan.

"Dependents" means an employee's spouse, domestic partner and unmarried children under nineteen (19) years of age.


Domestic partners must certify by affidavit that they:

As partners are at least eighteen (18) years of age and are mentally competent to contract
As partners are not married to anyone
As partners are not related by blood to a degree which would prohibit marriage in the state of Rhode Island
As partners reside together and have resided together for at least one (1) year
As partners are financially interdependent as evidenced by at least two of the following.
A. Domestic partner agreement relationship contract
B. Joint mortgage or joint ownership of primary residence
C. Two of: (if you use C you need to have 2 of these, plus another one from A, B or D)
(1) Joint ownership of motor vehicle
(2) Joint checking account
(3) Joint credit account
(4) Joint lease; and/or
D. The domestic partner has been designated as a beneficiary for the employee's will, retirement contract or life insurance.
