common law marriage

What is the name of your state? minnesota
my exhusband has two children with his girlfriend they have been together for about 7 years, he has not filed his taxes because if he is due a refund he knows that i will receive it. is there anything i can do legally to have him pay his back support or get them both to have to pay it. my son says that his dad pays rent at the house he lives in, he also owns a car what can i do to find out who owns or pays the rent to find out if his income is enough to be paying back child support (there is a court order for support) he now owes $10,100.00. how do i go about getting this? thank you for any help i may receive.

My response:

"does it really matter that i titled it "common law marriage"?"
*** Yes. For example, we don't know you or who you are. The ONLY way that we can determine your credibility (and veracity) is by what you post. So, you already lied about the subject. And when 'caught', you copped an 'attitude'.

So, at this point, we have no reason to believe ANY of your post. And since we don't believe it (added to your crappy attitude), the responsible posters on this forum can just decide to ignore you. But take heart, you WILL get responses from some..... the ones that have NO legal experience or knowledge, who 'feel the need' to post "Give me a hug" responses or maybe even from the forum troll. Let me introduce you to 'badtenant'.

So, to answer your subject, Minnesota does not recognize 'common law' marriages.

Oh, and 'what you want' has nothing to do with it!

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

I did not have an attitude when i replied i asked a question of did it matter because had the person responding said yes then i would have apologized I wasn't lying when I made this post the first person who responded asked me a question and I responded...you are the one assuming and having the "crappy" attitude, i came to this site for help but see I will have to look for professionals to help instead. You and only you JETX have given this site a bad rep.

Here is the point to your post... even IF your state reconized common law marriage it would have NOTHING to do with your case. You can NOT include your ex's wife's income to calculate CS. It's not her responsibility but his.

Okay, giving you the benefit of the doubt..... that your selection of 'common law' subject was in error.

Your question:
"how do i go about getting this?"
*** Several options:
1) Have you tried to contact your state agency at: http://www.dhs.state.mn.us/ECS/ChildSupport/Default.htm
2) You could consider hauling the 'ex' into court for Contempt of Court. While there, you can get answers to ALL of your questions as to income, employment, landlord, etc.
3) You could hire an outside child support enforcement agency.

thank you for your answer, i did not know that i could do these things. all that I ask of you is that next time someone like me (who are looking for answers, and unknowledgable (sp) about the law) are given the benefit of the doubt someone may be more desperate than myself and only have this site to go to for the help they're looking for.

My response:

So, you see nothing inherently wrong, or misleading, when you title your thread "Common Law Marriage"? And, you think it's "rude" when someone asks you what that has to do with your post? Do you think we're mind readers? Could it be, for all we knew, that you may have been "leading" up to something that had to do with your "title"? So, I was wrong to question you?

It's like opening a cook book, and then finding out it's a story about Godzilla!

Next time, be accurate.

read my post for 7/6/03 at 11:48 I explained myself. You are not a nice person, you are very rude and inconsiderate of people who do not know the law, you do and instead of being helpful you're hurtful. What comes around goes around, and one day you will learn how to treat people, that you think are beneath you. You're also the reason why lawyers get such a bad reputation. I feel sorry for you.

Wow, you REALLY are whacked-out. No wonder the old man is giving you trouble.

And, sweetheart, if you think you're my "equal", I've got to tell you, you're not. Yes, you are beneath me - - way, way down on the food chain.

Hey, I'm good for at least one complaint a day. I've been here for 3 1/2 years. Do you think you're the first to complain about me?

You'll notice, I'm still here.

And, you'll also notice that you're still a whacked-out skank bitch.
