Question

Common Law Marriage ?????


What is the name of your state? Georgia
I know that I am considered Common Law married to my spouse. We were actually informed this by the IRS a few years ago. My question is can we obtain a marriage certificate to prove our common law marriage? I have used his name for years, except for on my drivers license. I have to have a marriage certificate to officially do that. Also our current insurance company is requiring a marriage certificate as well. So can I obtain one and how would I do that?

My response:

Did you ever think of going to City Hall - - you know, that's where Billy Joe Bob works - - and filling out an application for a marriage license, and then (hold your breath) actually get married? That way, you'll have your necessary "certificate."

Some people in the South are real slow.

???? Georgia repealed its common law marriage statue about a decade ago. They no longer recognize common law marriage. But, I *think* if you started living together prior to the date it was repealed that they will still recognize it. Even if that's the case, I doubt you could get a marriage certificate. Call the county clerk's office and ask.

Really? I didn't know that. People in the south are not slow. I was just curious for your information. I truly have no interest in going to City Hall and all that just to change my name. If I wanted a traditional marriage I would have already done that.

You can't get a marriage certificate (OR be common law married) for a very simple reason - you're still married to someone else! Or at least, that's what you say in your other thread [url]http://forum.freeadvice.com/showthread.php?t=256808[/url] .

It always amazes me when people want all the benefits (filing status, spousal insurability, spousal retirement/SS) that having a "legal marriage" brings but don't want the actual marriage!

It amazes me that people are truly so rude and mean spirited. As I stated in my reply to my other posts. Who are any of you to pass judgement on me? You do not know my situation. Oh and by the way, no I do not live in a trailer. But I happen to have known various people throughout my life who have resided in trailers, and I must say I am not to sure what you were insinuating by that remark. But I guess it is safe to conclude that you are obviously one who looks down on people. Very sad. Life is to short to be such an a$$ hole, don't you think?
