Common Law marriage and living in a different country?

What is the name of your state? Alabama

My husband and I are from Alabama, we were married in 2000, and divorced in Early 2002. Later the same year, were back together. We have 3 children and call each other husband and wife. We file our taxes together, but never legally remarried. My question is, because we are living in Germany now, are we still considered common law married? Although, we live in Germany, we still pay Alabama state taxes so it is considered our state of residence now.
