What is the name of your state (only U.S. law)? Texas

I am in a common law marriage to my husband and desire to take his last name legally. I was thinking that I must file a petition for a name change with the court in order to do that. Is that the case or would a Declaration of Informal marriage be enough to legally change my name? Thanks for anyone's help.
