confusing situation/help needed


What is the name of your state? Georgia

I purchased a four wheeler in 2005 including a down payment and financing through Yamaha credit. The purpose of the purchase was for my boyfriend (at the time) and I to ride and go hunting with.

We ended up splitting up at the end of December 2005 which included a bit of domestic violence and I called 911, hung up and when they phoned back, nobody answered as I left the house so I didn't get beat up, which consequently ended up with me being put in handcuffs for DUI because I stupidly came back to the house. After alot more money was spent, I didn't not get charged with a DUI but "reckless driving".

When he moved out of my house, he took with him the 4-wheeler and has been making payments (although they are not the full amount nor on time). This is obviously effecting my credit since everything is in my name.

I spoke with our county sherrif and he stated that I could go and legally take the 4-wheeler from the residence that he is at now. I am hesitant to do this as I don't want nor need more legal troubles due to this person.

My husband (I married him in 2006) suggested I write a letter to this person and give him say 30 days to secure financing in his own name or return the 4-wheeler to me. My fear is that he will trash the 4-wheeler and I'll still end up paying for something that doesn't work or is too badly trashed that it is unridable.

Also, when I moved down here, I bought a pos car for $1500 cash. When he moved out, he asked to borrow the car since he had a gas guzzling vehicle, I said fine but bring it back when the week is over...well he sold it for $3000.00 which in turn means he forged the title of this car, isn't that illegal and am I not entitled to all of the money he made from the sale of this car?

I can't really afford to hire an attorney ( because every penny I had before I met this man, is long gone on his "stuff" he had to have) and I've decided (after talking with my husband) that I would let the car issue go as long as I can get the 4-wheeler back and get my credit back to where it was.

He went to a pawn shop and forged a check with my signature to purchase me a pistol, well when he left he took that with him as well.

I feel like such a fool and am very embarrassed by this situation. I know that it's been several years now but with the economy the way it is and I'd like to get my credit fixed before it gets out of control, I want to do something to remedy this sinking feeling.
What does anybody suggest that I do?What is the name of your state?

You waited three years? Go with the police to get the four wheeler and bring it home. Make the payments. It is too late about the check that you allowed him to write for the pistol. It is also too late about the car he borrowed and sold three years ago.

Thanks so much for a response. I am going to stop by the sherrif's office on the way home today and determine the best route to take for one of the officers to go with me. Do you suppose it makes a difference that he lives in another county?
