Is this contempt?The state is CT. In 1998, my husbands parents decided they wanted to pay for his sons tuition. They took over my husbands payment and continued to do this until he graduated middle school. Now, the boy is in HS and HER mom is paying the tuition to that as it is again a private HS. The ex wife AGREED to have her mom pay for this. Now, this past Sat, we received a letter from his ex threatening him with contempt of court b/c he didn't pay for the boys tuition, his parents did and that she would NOT go forward with it if he agreed to pay for their daughters tuition IN FULL b/c then he would come out even. There is a divorce agreement which states he si to pay 50% of school tuition, but he hasnt paid since 1998 b/c his parents wanted to do this for their grandchild. That was 6 years ago they started this and she is NOW saying he is in contempt. Inly the boy is mentioned in the decree, NOT the daughter. Is this a valid threat? Can she dangle this charge over him like this? She is also saying that she will sue him for all the money his parents paid out ...can you help me????? |

| If he was required by the order to pay all or part of the tuition, the court isn't going to care where the money came from. However, if he (or his parents) are no longer paying his portion of the tuition as per the order, then he IS in contempt. If the daughter's tuition isn't in the order, he's under no obligation to pay thath.

| If the CO'd payments are being made in a timely manner, I can't see any way that he is in contempt. There are many cases in which a spouse, for example, of a NCP may actually choose to make the CS payments while their spouse is not working. The fact that the payments do not actually come from the pocket of the NCP directly does not mean that NCP can be found to be in contempt- as long as the required payment is being made in a timely manner. Gee. The stuff some people waste time with. She's getting her money, what difference does it make whether they send it directly - or give it to him each month to send in??

Is this contempt...You mentioned that if he {or his parents} are no longer paying the tuition then he is in contempt....I can understand that- but can he still get in trouble with HER mother paying the tuition now IN FULL? The understanding from the beginning of him going to this particulare HS was that HER mom pay the tuition fees, as they are quite hefty- his ex wife worked this out with her own mother and he started this school in August. NO mention of anything regarding tuition payment from her until this past Saturday and then all the sudden he was getting threatened with contempt unless he pay the daughters tuition... |

Is this contempt?I'm sorry Belizebreeze- I accidentally hit your box when I was replying to another response. I will have to dig up the actual court papers, and that may take a little time- as to I have to search for them. Thank you for your time- sorry to frustrate you when i hit the wrong box. |

| Of course the CO is needed. Did he agree to the private school on the BASIS that the GPs would be paying the tuition?

I was just wondering if she had a real contempt case or was bluffing- to get him to pay. I will post the original CO when I find it... |
