My spouse and I have no credit cards in both of our names. She has 2 in her name with outstanding balances and I have two in my name with outstanding balances. Would this debt be equally divided or how would this credit card debt be handled in a divorce in a separate property state?

My response:

Unless you both signed the applications for the credit cards, each spouse would be responsible for their own debts. If both of you signed the credit application and contract, then you would both be responsible, and a judge would merely assign 50% of the debt to each of you.
