Thanks for your reply. My husband has sole custody of my stepson. Do we need to go back to court? Do we need to get full custody? Do you carry a permission slip around with you? What do you think of adoption/guardianship?

Sole custody is full custody. So you are fine there.
Yes, carry around the permission slip with you. In order for you to obtain guardianship or whatever, you would need to adopt the child. If she will relinguish her rights, you can adopt him. Does she pay child support? If not, she should and you should go to court for it. Sometimes just the thought of a deadbeat parent having to pay child support will push them to relinguish rights, as they don't want to pay.
