Dealing with Fathers Fraudulent Debt.


What is the name of your state? Utah

*sigh* this is a big one... But Any advice would be appreciated. I'm unsure if this is the right forum to post this but here goes......


My Father had lived under HUD for as far back as I can remember. And I never knew much about them or their regulations, I was a minor child living under this roof. But as I became an adult I was never notified of any responsibility to them. My dad always told me it's under his name and basically none of my business. I became suspiscious when my husband moved in over 3 years ago my father failed to report it and any of my financial adjustments. But he still did not involve us.

Well to make a long story short durring the last inspection we were called in- all of us- to have a meeting with the lady handling my fathers case and we answered everything honestly to the best of our ability. I deal with medicaid and am awear that you do not fraud out any govt. assistance programs no matter what. Needless to say thay dropped my father out of HUD and told him to expect some back pay.

Now today a man from a collection agency talked to me personanlly on the phone. And he is saying that me and my husband are also expected to help pay off this back pay. And I wonder if there is any way to fight this legally. Because we were never formally classified as renters, eventhough he stated both our names were on the lease! My fathers caseworker did not even involve us into this until that day! I don't feel like we should be held accountable for this especially being that this was originally my dad's file and he didn't involve us into it either. Any imput would help please. Thanks in advance.

The collection agencies are notorious for lies & deceit. They get paid a commission on what they collect. Tell him to kiss your @ss. If you didn't sign a lease, you cannot be held responsible. You cannot be forced to fulfill somebody else's contract. He needs to talk to your father ONLY.

Okay, the search is over. He called me back today. Me and my husband signed our names when we had that meeting so we're all 3 held responsible. And we also have to come up with half the total real soon -5,444. Or else it is a 2nd degree felony. Nice life hu? love you too dad!

Well me and family wont be moving away like we planned. I'm stuck in this place. I barely make enough to cover groceries for me and my husband and 2 kids, my husband don't make much either. Some months we have to skimp on bills. Life's real crappy right now. We can ALMOST cover that 5,000 with our returns. so that is no worry.

Ah well thanks anyways for your response, I'd pray for something better, but I think I just about lost any faith I used to have.

It's a shame that you have to spend your tax refund on this awful mess. I'm sure you had better uses planned for it. Maybe you can appeal and stall the process for awhile. You have my sympathies. Did you thank your father?

Is it possible to Appeal this?

Yes, we did plan on making a better life for our family with this money. My husband's mom is having so many health problems, and it's getting worse. She's never met me or her grandchildren. If we move there we would be around people who appreciate us- my blood don't :-(. We already have jobs lined up that pay much better there.

They mention 2nd degree felony and I'm scared to death. I'm a wonderful mom, I love my kids, I've tried to lead a good honest life and I'm a big ball of stress over this. We finally saw a chance to start a new fresh beginning, but not anymore.

If it were possible to appeal this how would I go about it? Thank you again for your time.

I don't know if you can appeal this, I was just suggesting it might be possible. Call the caseworker and ask her about an appeals process. They might tell you how it's done.

I don't have any knowledge about HUD. Sorry I can't be of more help. I wish I could.
