| virginia my husbands ex girlfriend in which he has a 6 year old child with went and told the magistrate that i made a threatning phone call to her. that i cursed and abused her. which led to my arrest in front of my 4 year old child and hers. this is nothing but lies to use against my husband in a nasty custody/visitation dispute. i hired an attorney and he said that when he gets me off of the charges we will discuss stopping her from doing this again but my question is can i press charges against her for lying about me and have her turn around and pay me back for lost time at work to go to court+ expensive attorney fees to defend myself over a lie. |

| My response: 1. Merely telling a judge certain allegations (whether true or false), in and of itself, does NOT get you arrested. Something you did in court, that you are not talking about, is what got you arrested. 2. Anything she says in court about you, or anyone, is protected speach AS LONG AS IT IS SAID IN COURT. You cannot stop her from saying whatever she wants WHILE IN A COURTROOM. IAAL |
