Dispute over automobile ownership


What is the name of your state? Indiana
I signed a loan agreement for my live in boyfriend to purchase a truck. The truck is now paid for, but it is titled, registered and insured in my name. I am going to take the truck. I understand he can sue me civily...what could be the possible outcome. He did pay for the truck..but did alot of damage when he moved out.

Any advice?

I'd say don't steal his truck. You had a signed agreement and now you want to break it.
Any other matters you may have are separate matters that you should take him to court for.

If the truck is in your name only, its your truck. However, unless the amount of damage that he did when he moved out, is at least as high as the value of the truck, morally that would be a pretty nasty thing to do.

Truck ownership


Let me go into more detail...I didn't sign any agreement with him...I just signed the loan papers. At the time we made this purchase my car was having mechanical issues and the delearship suggested that I replace mine at the same time...stating it would be difficult for me to obtain a loan for yet another car when mine needed replaced. His loan was for 6 years. With the understanding I was in a long term partnership, and his statement was neither of us was going anywhere, I took on a loan for a car that alone I coudn't afford. He was paying half of all our expenses. He then took up with alot of other women and when I moved out of his bedroom...he moved out, leaving me in a very bad financial situation. I do understand what I doing is morally wrong, but I'm facing garnishment.

It is not morally wrong to take your vehicle.

Based on the additional info posted, I would say it is the OP's vehicle to do with as she pleases...

Boy I wish we would get the full facts in an initial post...

Auto dispute...


I'm sorry I didn't fully explain myself...I wanted to try to keep the details clean...and since I am still very emotional about the situation, I wasn't sure what was relevent. My real concern is can he pursue me with civil suit if I sell the truck.

A: Of course he can. This is America. You can sue anyone at any time for anything at any place.

Be prepared to lose however and have MM get a restraining order against you. You can sue him but winning is a different story.
