Divorce


What is the name of your state? nc
simple divorce- if both parties agree on terms including child custody, child support, visitation, property division etc....is it necessary to have papers served or would notorized signatures on the divorce agreement suffice? Is child custody and support an issue that must be decided by the court if both parents agree?

The papers don't have to be served but proof of service must be in the file. This can be a waiver of service signed by respondent. The court encourages parties to work out the issues but the order does have to be approved by the court--i.e. judicially signed and entered in the court file.
