you guys are great. i am so glad i have someone at least on line to vent with. this has been in the closet for 25 yrs haunting me everyday. i have no one else i wanted to confide in because of the embarrassment of it.. my next worry is, if he agrees to this home test and she insists on persuing this further, she will have the legal right to change her birth certificate, right? the only mention of him being her father was made by her when she first got pregnant 25 yrs. ago.. and as i said he denied it all these yrs. after meeting with her and seeing pictures of her growing up, she does look a whole lot like 2 of our other sons, but he never expressed that in words to her.. he just told her that it was possible that he could be but there were other men involved too.at least 4 that we know of.. and being the "male" thing to do they all denied it and pointed the finger at each other..
now, the birth certificate thing, she never showed him one, so he doesn't know if the mother put him down as the father or not, but we were told he did, she did not raise her with our last name though. if she can get the birth certificate changed, she has a legal stick up our butt when it comes time to divide assets with our other children right? most everything we have is in my name, because i always feared this, but our house, the bank would not put it in my name only because they had to go with both our incomes on the loan... is there a way to get that in my name only before it is paid off???????? and wouldn't they consider anything of value that i own as grounds for determining a dollar figure for support if it comes to that, including my income and my business?
if they mess with my business someone is in deep doo doo...it is in my name only too...
thanks a mil.

I really, really don't think you have to worry about support. As for your wills, it depends on your state laws, for the most part, they are the same. Here we just name them in order to exclude them. For instance, my husbands children are listed as such:

Disposition of Property:

Specific Bequests: I direct that the following specific bequests be made from my estate:

1. $1.00 in dimes to be destributed to SS. If this beneficiary does not survive me, this bequest shall be distributed to SD. If this beneficiary does not survive me, this bequest shall be distributed with my residuary estate.

Hon, why don't you go see a lawyer? This is eating you alive!!!!!! Most give free or low cost consults. I'm sure that he/she can put your mind at ease better then what we are doing here. Stress is a killer and I know you gotta be an older woman such as myself since we have older kids the same age. *LOL* Please, do it for you!

*HUGS*
