Question

domestic partnership and other family law matters


i used to be in a very abusive relatonship with this guy from okalahoma and we ened up haveing a kid togeather .we where never married and when i sighned her birth certificate i used his last name instead of my own simply because i was told i had to if i didnt i would get it when we got home . so i sighned his last name because i had just given birth and i didnt feel like being in any more pain then i already was. i was was wondering if i had to get a divorce from him and how i would go about changing my last name on my daughter birth certificate . and my daughters as well

That would depend upon whether you met the standards in OK.

The standards are this:
Oklahoma. The parties must be competent, agree to enter into a marriage relationship, and cohabitate in order to be considered as having a common law marriage.

You would file with the court for a name change, and would need Dad's consent to change your child's name. I would imagine you would file with the court to change your name.
