Elder spouse incompetence


What is the name of your state? Florida

I'm asking this question on behalf of a dear sweet lady who is slowly being drained of life by a selfish, demanding, verbally abusive invalid husband.

He is 87, bed-ridden, unable to feed himself, relieve or clean himself, and demands that she, at 86, come at once when he calls, often 30+ times a day, for no reason other than his wanting company. He was diagnosed as having Altzheimer's along with depression and other maladies, and occasionally demands that she bring him his loaded rifle to examine.

This daily drain on her frail frame is slowly killing her, and he refuses to stay in a nursing facility for more than a few days or weeks.

My question: What would it take for her to be able to declare him incompetent, so that she can force him to live in a nursing facility?

His medical doctor's recommendation.

Suggest she talk to an attorney and consider drafting a Durable Power of Attorney.

Florida has nursing homes that specialize in the care of Alzheimer's patients. His wife should place him in one of these homes. They will not allow him to sign himself out and they can help her make all of the necessary arrangements for power of attorney and such.
