Is it legal for a husband to hack his wife's email account on their home computer to gain access to private and personal information (i.e. Photos and letters), and then use it against her in the divorce settlement? (counter claim)
Does this fall under the criminal act - section 2511 "Interception and Disclosure of wire, oral, or electronic communication is prohibited"
Is there such a privacy Act that can protect her in this issue?

What can we do to protect ourselves?

Yes. People can do whatever they want on their own home computer, as far as looking at files on it.

I don't know if your state is a no-fault state or not. If it is, then your affair won't matter as far as property distribution, unless you were spending a lot of marital money on your "friend" or unless it somehow affected the children and there is a custody fight going on.

It might be embarrassing to you that he found out, but it's completely irrelevant in most cases in no-fault states.

Some advice that isn't necessarily legal: Next time you have an affair, don't leave proof of it on your computer. Or better yet....
