Emancipation in florida


What is the name of your state?Florida

Ok, My dad passed away a few months ago, and at that point i was living with him in the state of georgia. Now my mom has custody of me and i live in florida. I'm 15 and will turn 16 in april. I'd like to know if i could move to my stepmoms house and live w/ her in georgia until i move out to college. Atm i have no job, and the family situation here is aful. My mom has called the cops on them telling them i ran away and stuff, when i just walked out to have some time alone. This has happenned 5 times already. By the time the cops get there im already home, and didnt know they called them. Although i have no job, my dad was in the army and i recieve benefits totalling about 3k a month. My step mother has also agreed to take me in if i happenned to get emancipated. Thanks in advance for the help.

The only way you can do that is to have your mothers permission (suggest IN WRITING).

And to get emancipation in Florida, you must be at least 16 and the petition MUST be "filed by the minor's natural or legal guardian" (§473.015). This means your mother would have to file the petition with the court.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

By the frequency with which this question comes up and the specifics that are generally included in the question, it is becoming increasingly clear to me that a great many people (adults as well as teens) do not understand what emancipation is.

Emancipation is NOT "divorcing" your parent(s) so that you can go live with your stepmom, grandmother, Aunt Susan, best friend's family, boyfriend or girlfriend (or their families). Emancipation means you are able to completely support yourself, on your own, with no help. In most if not all states, that means paying, yourself, for rent, food, medical services, transportation, taxes, shoes, shampoo, movies, etc. etc. etc.

Not all states will emancipate a minor. Of those that do, I know of only one that will even consider emancipating anyone younger than 16 (and that state does NOT guarantee it); many states will not emancipate anyone younger than 17. I know of no state that will permit minor emancipation without parental permission and/or a court order.

this is crazy


So basically, your saying i have no control over the situation... Theres gotta be something i can do. I understand the factthat i have to support myself, but when theres another place that paople will take me in, wouldnt that help my case. My mom wont listen to my feelings or wishes, and thinks she's doing the best thing for me, but i know that this isnt the best thing for me. I mean - she's called the cops on me 5 times for nothing. How am i supposed to get passed my dad dying, when im constantly in trouble for nothing? Last time she called the cops, she lied and told them i hit her... Is that really gonna help my situation? I spent most of the night sitting in juvenile assessment center, and i didnt even come close to hitting her. Cause i know my dad woulda kicked my butt. When she lies to the police and stuff how is my life supposed to be better. I used to live with her, up until my stepdad beat me, and even b4 that i still wanted to move away. This isnt nearly the better place for me to go. When i lived in GA, it was the first place that ive actually been happy... She came up and snatched me away from that 3 days after my dad died. 3 days... I mean - cmon... Your telling me a judge wont let me do anything without her permission, even when she goes through all that to get me into trouble for nothing. If thats the case, i think the laws of emancipation need to be re-evaluated, because its just plainly idiotic. Tanks for your info though, cause it does help a bundle.

You get to make these decisions on your own when you're 18. Unfortunately, those police reports of your Mom reporting you as a runaway won't help your case for emancipation, either.

At this point, your best bet may be to concentrate on school and extracurriculars. See if you can get in to see the school counselor for help in coping with your father's death and the aftermath of how your life has changed. I'm sorry for your loss.

I'm not saying there's nothing you can do; I'm saying that emancipation is not necessarily the answer.

So many teens immediately jump on "emancipation" as their first, best, and only solution when it is clear that they don't know what it means or what it entails.

With your mother's permission; with a court order; with help from Child Protective Services (or whatever your state calls it), maybe you can live with your stepmom. But not through emancipation. That's not what emancipation means.

With the history of abuse and the circumstances you describe, call CPS also ask for a guardian ad litem, they may be able to place you and act on your best interest. While it is true that, you could be emancipated with the income you have and most likely $3k p/m is why your mother has you there, without you there, the income goes to you/your gurdian. A Guardian ad Litem may be your best bet to get you back to GA at least you were there before and hopefully doing well?
