| Enforcing a Consent Order I live in North Carolina, on February 1, 2001, I entered into a Consent Order with plaintiff (my ex-wife and her counsel). As part of the order we were to undergo a Custodial Evaluation, which was finally completed on November 12, 2001, when it was supposed to have been completed in 10-12 weeks. Also, it was ordered to establish and conduct family counseling.
To date we have not had even one session of counseling. Despite my repeated requests to my former attorney (I finally released him), and correspondence from the plaintiff and opposing counsel stating how they; support, encourage, and wish to undertake the counseling on several occasions.
I have written opposing counsel and directly requested for the counseling to begin without further delay. I provided a deadline of February 14, 2002 to have some sort of beginning. Counsel did not only completely ignore my letter, but any following calls to request a conference.
How can I go about enforcing the consent order? Is there a way that the plaintiff and/or her counsel can be held in contempt of court for ignoring it so long? Any advice or suggestions to help resolve this matter would be very welcome. |
