engagement ring

We live in CO and my son's fiance refuses to give the engagement ring back. We had understood that the engagement ring is unlike gifts and is considered part of a contract. If he was the one to break the engagement after finding damaging history, is she legally obligated to return the ring? Of course we think she is morally obligated.

Thanks Zephyr, completely agree. Tell me please though, do you KNOW that she must return the ring or just agree morally she should?

several attorneys on this forum have said that legally she should return the ring regardless of the reasons for the wedding not happening
