family


What is the name of your state? Florida

I always knew I was raped as a child by my step-father. My step father just killed himself and all the memories came back. I started talking to my mom who stated that he is dead and just forget it. I didn't. I was hypnotized by a professional doctor and it all came out. My mom refuses to accept it and now has decided not to talk to me. She has never denied it happened or that she knew but feels he is dead so let it die also. Can I take this to court so my mother will listen to a professional with the truth? This is something I have lived with for 44 years. No more

My response:

Sorry, but "yes more."

You said, "I always knew I was raped as a child by my step-father", and since this happened 44 years ago, any applicable Statute of Limitations has expired decades ago. It doesn't matter that you were vividly "reminded" of the facts; what matters is that you failed to take any action on this matter soon after you became an adult - - and your adulthood occurred years and years and years ago.

I am 44 now. It happened 30 years ago. I did bring it to my mom when I was teenager. I did bring it up to my mom when I was in college. I did not want to ruin my mothers marriage. I was scared and threatened. So I just stayed away. When he died, I was only sad for my mother's loss not for his loss of life. That is when I wanted to know if what I remembered was not a nightmare but true and it was. so because I was scared means tough deal with it now?

Being "scared" is not a defense. Lots of people are "scared" of the litigation process, but most forge ahead with their claims despite their fears. Thirty years is just way, way, way too long.

The law requires that all complaints and claims MUST, at some point, come to an end - - and yours came to an end years ago.

Have you received therapy?

"I am 44 now. It happened 30 years ago." So you were 14 when you were raped. In your initial post you claim you had to go to a hypnotist to remember. What didnt you remember when you were 14? It sounds like you are not sure it happenned.

Again, maybe I am expressing myself wrong. I did know at a young age and went to my mom. she stated it was a dream it didn't happened and it was dropped. In college, I brought it up to my sister. We cried about it, she said she knew but we have to move on because my mom was so happy. Everyone where i grew up think i have this cinderalla family. Then i just went to my 25 year reunion and my best friend and i started talking and she brought it up. She informed me I told her 30 years ago and that is why when she spent the night we slept in the living room not my bedroom. I brought this up again with my sister and then my mom and they stated that since my father is dead, let it go. I am 100% sure it happened but I guess I just felt I needed proof on paper and by a professional. I have been going to a theraphist. I have overcome the hate I have for my stepfather but now I am in a battle with my family because I won't drop it. I just want them to admit it happened. Now I just found a different birth certificate from the one I had for years with different information on who my real father is. So there seems to have been so many secrets that I am now digging up now.
