Lawyers get paid by the hour. Not by whether they won your case. Just like doctors don't get paid only if they cure you. Just like most employees get paid weekly, bi-weekly or monthly, not when they finish a particular project. If you didn't get paid for 2 months - would you keep working? Or would you tell your employer that you expect to be paid or you're not working?
