What is the name of your state? north carolina

i am trying to get my fiance on our baby's birth certificate. the problem is in north carolina you have to be divorced for 265 days. my divorce was final november of 2005 and the baby was born march of 2006. i have the form to put the father on the birth certificate but i have to have an affidavit from my ex-husband saying he is not the father. my question is can he just type up a statement and have it notorized or do i need a lawyer? please answer as soon as possible my fiance is going into the military and we need to have this taken care of. thank you
