Hi, I am looking for information for my cousin. I want to find either some websites or phone numbers to find out information regarding a fathers legal rights. I tried google, but most of the sites that came up are for hiring attorneys and I dont think he wants to go to that road yet, but i would like to find out more about the laws and such for fathers. I dont knwo all the details about what exactly is going on, but if need be i will let you know all I know if that will help getting the sites and/or numbers.
Thank you,

janet | Ummm.. laws aren't gender specific normally. What type of information are you looking for? Fathers have the same legal rights mothers have unless the father and mother were never married or a court has decided otherwise. |

| | | I guess im not specifically looking for laws, just general information.
All I know right now is that yes they were married and divorced( i belive in colorado). I dont know exactly what the court specified for visitation, i just know that the mother has primary custody. They are now both residents of florida and she wants to move back to colorado. He wants to either find a way to stop her from going or get primary custody. I know if he wants custody then he will need a lawyer, but i have heard aout different orginizations that help with information and help you find the right attoney and some that are kinda like support and such. I just wanted to mabe get the info on some of these orginizations so that i can pass the info along to my cousin.
thank you for your response and i hope this helps

janet | He needs t o post because there are too many variables. Exactly what state is the order in? Did mom petition the court to move out of state and get permission? Have the orders been transferred to Florida -- does Florida now have jurisdiction? HOw old are the children? Is the move the only reason for him getting custody? Does he have legal custody? JOint physical? Yes i know you said mom has primary but that doesn't mean that is the whole story. |

janet | First, if the orders were never transferred to Fl. the first thing to do is file a motion to change venue to Fl. Then he can file a motion to prevent her from moving, at least until a court decides. However, Florida will have jurisdiction only if one or both parents have lived in Fl for at least 6 months.
If the case will stay in CO. you can find links to the statutes by going to www.govengine,com
If the case is going to be in Fl. here are links for Fl.

| | | He may not want an attorney, but he's going to need one. And "father's rights" are simply "human parent rights." It's not really a matter of father vs. mother. It's what's best for the child.
